Film8 Terms & Conditions
Last updated: 2 October 2026
These Terms & Conditions ("Terms") apply to the website, services, bookings and projects provided by Film8 AB ("Film8", "Film8 Studio", "we", "us" or "our").
Film8 AB is a company registered in Sweden under organisation number 559417-8393, with its studio at Lilla Nygatan 19, 111 28 Stockholm, Sweden.
These Terms may apply when you use our website, request or purchase our services, accept a quotation or booking confirmation, receive an invoice, or make payment through a payment link.
Where a separate quotation, production agreement, order confirmation or other written agreement has been agreed with a client, that document will take precedence over these Terms in the event of a conflict.
1. Our Services
Film8 provides photography, videography, film production and related creative and production services, including, among other things:
· commercial and event photography;
· corporate and individual portraits;
· video and cinematography;
· aerial and drone imagery;
· studio production;
· location fixing and production support;
· post-production and retouching;
· graphic and visual production;
· digitisation; and
· other related creative services agreed with the client.
The scope, price, schedule and deliverables for a specific project will normally be set out in a quotation, booking confirmation, invoice, email correspondence or separate agreement.
Information and prices displayed on our website are for general information unless expressly stated otherwise and do not constitute a binding offer.
2. Bookings and Agreements
A booking or project becomes binding when it has been confirmed in writing by both parties, when the client accepts a quotation or booking confirmation, or when the client makes a payment or deposit relating to an agreed booking.
Email and other electronic written communications may constitute written confirmation.
Unless otherwise agreed, quotations are based on the information and scope provided by the client at the time of quotation. Material changes to the scope, schedule, location, deliverables or production requirements may result in additional charges.
Where services are ordered on behalf of a company or organisation, the person placing the order confirms that they are authorised to do so.
3. Prices, Deposits and Advance Payment
Unless otherwise stated, prices quoted to business clients are exclusive of VAT and other applicable taxes.
Prices to consumers will be presented in accordance with applicable consumer law.
Film8 may require a deposit, booking fee, advance payment or full payment before confirming a booking or commencing work.
For appointment-based services, including photography and portrait sessions, Film8 may require full payment in advance, particularly for appointments taking place outside our regular business hours.
Unless otherwise stated in writing, 50% of the total booking value constitutes a non-refundable deposit or booking fee.
The deposit is charged in consideration of Film8 reserving the agreed date, time, studio capacity, personnel and other resources for the client, and may also cover administrative and production planning work carried out before the appointment.
Any estimated third-party costs, including travel, accommodation, equipment rental, locations, permits, models, talent, assistants, couriers, props or other production expenses, may be charged separately unless expressly included in the agreed price.
Any mandatory consumer rights that cannot legally be excluded remain unaffected.
4. Payment
Payments may be made by bank transfer, invoice, card, payment link or another payment method offered by Film8.
Invoices must be paid by the due date stated on the invoice. Any deposit, advance payment or payment schedule stated in a quotation, invoice or booking confirmation forms part of the payment terms for that project.
Payment links may be operated by third-party payment service providers. Where this is the case, the payment provider may apply its own technical terms and privacy practices.
Film8 does not normally receive or store complete payment card details. Card information is generally processed directly by the relevant payment service provider.
If payment is overdue, Film8 reserves the right to charge applicable late-payment interest and reasonable recovery or collection costs in accordance with Swedish law and to suspend delivery or further work until outstanding amounts have been paid.
Unless otherwise agreed, bank charges, currency conversion charges or similar fees imposed by the client's bank or payment provider are the responsibility of the client.
5. Payment Links and Invoices
A payment link or invoice may refer to these Terms.
Payment of an invoice or payment request does not by itself modify the scope, price, usage rights or other conditions previously agreed between Film8 and the client.
Where a quotation, booking confirmation or separate agreement exists, it should be read together with the invoice or payment request and these Terms.
For consumer transactions, nothing in these Terms limits rights that cannot lawfully be excluded or restricted.
6. Cancellations and Rescheduling
Unless different cancellation conditions have been agreed in writing for a particular project, the following applies.
Private appointments and photography sessions
A booking is considered confirmed once the required deposit or advance payment has been received.
Unless otherwise agreed, 50% of the total booking value is non-refundable in the event of cancellation by the client.
Where the client has paid the full booking amount in advance, any refundable balance will be determined according to the cancellation conditions communicated at the time of booking.
Bookings taking place outside Film8's regular business hours may require full payment in advance.
Film8 reserves the agreed appointment time exclusively for the client and may decline other work as a result. The non-refundable deposit therefore remains payable even where the client later decides not to use the reserved appointment.
Rescheduling
Film8 may, at its discretion, allow a booking to be rescheduled.
Where a rescheduling request is accepted, the deposit may be transferred to the new booking date instead of being forfeited.
Rescheduling is subject to availability and may be subject to additional charges, particularly where personnel, studio time, equipment or third-party services have already been booked.
Repeated rescheduling may be treated as a cancellation.
Cancellation by Film8
If Film8 is unable to provide the agreed service for reasons attributable to Film8 and a suitable alternative date or replacement cannot be agreed, amounts paid for services that have not been provided will be refunded.
This does not affect provisions relating to force majeure or circumstances outside Film8's reasonable control.
7. Consumer Right of Withdrawal
Where a consumer enters into a distance or off-premises contract with Film8, the consumer may have a statutory right of withdrawal under applicable Swedish and EU consumer law.
Where such a right applies, the withdrawal period is generally 14 days from the conclusion of a contract for services.
If the consumer expressly requests that Film8 begin performing the service during the withdrawal period, the consumer may, where permitted by law, be required to pay for the proportion of the service already performed if the consumer subsequently withdraws.
Where the service has been fully performed during the withdrawal period, the right of withdrawal may cease where the statutory requirements for this have been fulfilled.
Any mandatory rights under applicable consumer law take precedence over these Terms.
Consumers wishing to exercise a statutory right of withdrawal may contact Film8 at info@film8.se.
8. Client Responsibilities
The client is responsible for providing Film8 with accurate and timely information required to carry out the project.
Unless specifically included in Film8's scope, the client is responsible for obtaining any permissions, approvals or authorisations necessary for the production, including permissions relating to locations, property, trademarks, artworks, music, confidential materials, participants or other third-party rights.
Where the client supplies materials to Film8, the client confirms that it has the necessary rights and permissions for Film8 to use those materials for the agreed project.
The client must inform Film8 in advance of any unusual safety risks, restrictions, access requirements or confidential circumstances relevant to the production.
Delays, additional work or expenses caused by incomplete or inaccurate information, changes requested by the client, restricted access or circumstances under the client's control may be charged additionally.
9. Production Time and Overtime
Production times stated in a quotation or booking confirmation are based on the agreed schedule.
If a shoot or production extends beyond the agreed time because of requests, delays or circumstances attributable to the client or the client's representatives, additional time may be charged at Film8's applicable hourly, half-day, day or overtime rate.
Any specific overtime provisions stated in the relevant quotation or agreement take precedence over this section.
10. Delivery and Revisions
Delivery dates are estimates unless Film8 has expressly agreed in writing that a deadline is guaranteed.
Film8 will use reasonable efforts to meet agreed schedules but is not responsible for delays caused by circumstances outside its reasonable control.
The number of deliverables, format, resolution, editing level and number of revision rounds are determined by the relevant quotation or project agreement.
Requests outside the agreed scope, including additional edits, versions, formats or revision rounds, may be charged separately.
Unless otherwise agreed, Film8 is not required to retain project files indefinitely after final delivery.
11. RAW Files, Source Files and Project Files
RAW photographs, unedited footage, project files, working files, timelines, graphics source files and other production materials are not included in the final delivery unless expressly agreed.
Where Film8 agrees to provide RAW footage, source files or other working materials, additional charges and licence conditions may apply.
Delivery of such files does not automatically transfer Film8's underlying intellectual property rights.
12. Intellectual Property and Usage Rights
Unless otherwise expressly agreed in writing, Film8 retains the copyright and other intellectual property rights in works created by Film8.
The client receives the usage rights or licence agreed for the relevant project.
The scope of such rights may be defined by factors including media, territory, duration, campaign, purpose and whether the use is commercial, editorial, internal or personal.
The client may not sell, sublicense or transfer Film8's work to unrelated third parties beyond the agreed usage rights unless Film8 has given written permission.
Where a full transfer of copyright or broader usage rights has been specifically agreed, the relevant quotation or agreement will govern.
Nothing in these Terms transfers rights owned by third parties, such as music, fonts, stock media, talent, models, locations or other licensed materials.
13. Portfolio and Promotional Use
Film8 may wish to display completed work in its portfolio, website, social media, showreel, awards submissions or other self-promotional materials.
Such use is subject to applicable law, confidentiality obligations and any restrictions agreed with the client.
If a project is confidential, subject to an embargo, or must not be used for Film8's portfolio, the client should inform Film8 in writing.
14. Third-Party Services and Expenses
Film8 may engage subcontractors, freelancers, studios, rental companies, couriers, retouchers, production suppliers or other third parties where appropriate for a project.
Where Film8 purchases or arranges third-party services on behalf of the client, such costs may include reasonable production, handling, coordination or administrative charges where agreed or indicated in the quotation.
Film8 is not responsible for the independent acts or omissions of a third-party supplier beyond the extent required by applicable law, although Film8 will use reasonable care when selecting and coordinating suppliers engaged directly by Film8.
15. Weather, Permits and Circumstances Outside Our Control
Certain productions, particularly outdoor, aerial and location-based shoots, depend on weather, access, permits, safety conditions and other circumstances outside Film8's control.
Film8 may postpone, alter or stop an activity where reasonably necessary for safety, legal compliance or technical reasons.
Film8 will not be liable for failure or delay caused by events beyond its reasonable control, including severe weather, illness, accidents, transport disruption, governmental restrictions, venue closures, power or network failures, industrial action, war, civil disturbance or other force majeure events.
The parties will, where reasonably possible, cooperate to reschedule or find an alternative solution.
16. Equipment Failure and Data Loss
Film8 maintains professional production workflows and takes reasonable measures to protect captured material and project data.
However, no camera, storage medium, computer system or transmission method can be guaranteed to be completely free from technical failure.
In the event of material loss or technical failure, Film8's liability will be determined in accordance with applicable law and any specific agreement with the client.
Film8 will not be responsible for loss caused by the client's own systems, storage, transfers or modifications after delivery.
17. Confidentiality
Where Film8 receives confidential business information from a client in connection with a project, Film8 will take reasonable steps to protect it and will not intentionally disclose it except where required to perform the project, with the client's permission, or where required by law.
Specific confidentiality or NDA terms agreed separately will take precedence.
18. Personal Data
Film8 processes personal data in connection with enquiries, bookings, productions, invoicing, payments and website use.
Details about how Film8 processes personal data, including payment and invoice information, are set out in our Privacy Policy.
19. Website Use and Intellectual Property
Unless otherwise stated, the Film8 website and its contents, including photographs, videos, text, graphics, logos and design elements, are owned by or licensed to Film8 AB.
Website content may not be reproduced, republished, commercially exploited or distributed without permission except where permitted by applicable law.
You must not attempt to interfere with the security or operation of the website, introduce malicious software, obtain unauthorised access or use the website for unlawful purposes.
Third-party links are provided for convenience only. Film8 does not control and is not responsible for third-party websites or their content.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Film8 will not be liable for indirect or consequential losses, loss of profits, loss of business opportunities or similar economic losses resulting from the use of the website or Film8's services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
Mandatory rights available to consumers are not affected.
21. Changes to These Terms
Film8 may update these Terms from time to time.
The version applicable to a particular booking or transaction will normally be the version made available when the relevant agreement was entered into, unless otherwise agreed or required by law.
The current version will be published on our website together with its last-updated date.
22. Governing Law and Disputes
These Terms and agreements with Film8 are governed by Swedish law unless mandatory rules provide otherwise.
Disputes should in the first instance be addressed directly between Film8 and the client in an attempt to reach a reasonable solution.
Where a dispute cannot be resolved, it may be submitted to the competent Swedish courts.
Consumers may also have the right to seek assistance from applicable consumer dispute-resolution bodies. Mandatory consumer rights regarding jurisdiction remain unaffected.
